Transparency bug

I am using 3.5R3 on Windows

When I have a subtool that is hidden partially inside another subtool, in earlier versions I was able to click on transparent and using the move brush, I could move vertices that were hidden. Now I am unable to.
Does everyone have this same bug?

This bug happens 90% of the time.

Have you turned on Ghost-Transparency?
