copyright question ???

If i use my zbrush name as my signiture, and not my real name, is it still copyright? Or do i have to use my real name?
Because im thinking i should start putting a signiture on my work.

As I understand the copyright laws, as long as you have the copyright symbol, your name and the creation date, the image is legally yours.

Copyright is based on the “original date of creation”, ie: open an image file you created and look at the properties. It states the date that you saved it to your hard drive as the date of creation. “If somebody copies a graphic from your web site I assure you that the date of creation on your copy of the file is earlier than the copy taken off your web site. If that still doesn’t feel like enough proof for you, save everything to a floppy disk and mail it to yourself via certified mail. Keep the envelope sealed, wrap it in protective plastic and put it in a safe place.”

That being said, a pseudonym has no existence as a “legal” entity. The Copyright Office warns that using a fictitious name could raise legal problems regarding ownership of the copyright and suggests that you consult a lawyer first.

Conclusion: Use your real name, and save the original image. You can, of course, copyright the pseudonym as yours.

BTW- I love this image! Please do copyright it so no one can steal it and claim it as their own! :+1:

lets say i wanted to add audio from a site but the site said © Website content copyright © 1996-2002 BUT then said Songs on this site are provided for free download by the artists.
would this give me the right to use it for free or maybe to Sell in another program?.
do you need to use the copyright symbol © when making a pic like Pixolator did but i don’t think he used the symbol of copyright © when there was a convertation about when some one used his image with out his permission

very nice image…the mail yerself things sounds very novel…Kathy I am sure has some wisdom on the copyright laws…internationally though I think it’s easier to get screwed over though…I think that has happened to DeeVee with some of his artwork as well as Pixelator and Southerns…

Well, the latest copyright laws say that you don’t even need the symbol. Copyright is granted upon creation. Proving it is a different story…

You know…there are two words that come to mind when I see this…Elven Grotto…don’t know why but it reminds me of Lord of the Rings. this is fantastic work! The translucent crytal like qualities of the rock formations are wonderful. The shimmering lights about the flowers and the mushrooms growing in the corner give it a Fey feeling! As far as copyright goes, I have had some of my designs stollen and sent to the far East to be made. As I have been told by numerous Lawyers once some part of the image or item is changed , it becomes a new creation. What I have done is to the mail myself a registered package with my image or design and leave it unopened. You can put any date inside, because you are the only one who would know what the date was.
Within the last few years I have included a small image within all of my images, you would have to look very hard to find it as it is usually hidden in the design. That way I can always recognize my own work. An example is the monkeys in my Regrowth image.

There is one more surefire way to claim an image as yours: embed a digital watermark into the image. Doesn’t matter how much the image is cut up or altered, the watermark remains.

hey wouldn’t a program that snap shot a image and can crop it wouldn’t that kill the watermark.
or even uploading it like here at the forum.
i don’t know what a water mark does but i persume it marks a idification in the image jebrish text it self with in the image

Thanks for the information Indigo, I will look into it.
It is very difficult to put a digimarc on a bit of Black Coral or Caymanite, so that is why I incorporate a mark into the item that is not easily identified. That is apart from my Copyright mark, which would be JJ 18k. or whatever material I am working in at the time.

Your implied copyright runs under your real name as well as any other monikers you would use. If you sign your pics with Envoken it is “understood” to be swappable with your real name. Same difference.

Copyright laws (in the States) take effect the minute you “save” your artwork to your harddrive. That is considered published. Personally, if I feel uncomfortable, I go ahead and spend the $30 bucks to get a cert of copyright (the certification allows you to list all artist names applicable to the piece)

It is incredibly important to understand one thing about copyrights. They are only as powerful as the amount of effort YOU are willing to put behind the label.

Copyright infringement happens EVERYDAY, particularly on the internet and the international scene. You either accept it or spend BIG $$ fighting it. You have to be willing to back that little “c”. The law will not stand in your stead.

BTW: I don’t have alot of fear/respect for watermarks. I’ve got Maya PLE and am quite able to “eliminate” the watermark in postproduction in Photoshop! (Thanks Adobe!!!)

Personally I thought that every image you make is copyrighted anyway. If you made in image in photoshop , you can always prove it’s yours if you still have the PSD file with the layers for example. I dont really know how you could prove a Zbrush image is yours unless you made a Zscript for it. :slight_smile:

There’s always the *.zbr file to prove that the image is yours. It would be the same deal as having a *.psd image with the layer information.

im not sure what water mark does but what about puting your name right in the center or all over it soooooo small the naked eye can’t see it.

Yup, they could. :wink: But it’s kind of a cool idea just to do.

I hate to tell you this, but i can read it with my naked eye, try harder next time, its hard to write too small for me, i got better then 20/20 eyes :smiley:
